Welcome to Yayby. By downloading, installing, or using the Yayby mobile application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the App.
Yayby is operated by Andrew Hingston ("we", "us", "our").
Yayby is a baby milestone tracking app designed for parents and caregivers. You must be at least 18 years old to create an account. You agree to use the App only for its intended purpose and in compliance with all applicable laws.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to notify us promptly of any unauthorised use.
Certain features of the App may be available through in-app purchases. All purchases are processed by Apple through the App Store or by our payment provider, Stripe. Refund requests for App Store purchases are handled by Apple in accordance with their refund policies. For other purchases, please contact us at support@yayby.com.
All content, design, graphics, and software in the App are owned by or licensed to Andrew Hingston and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.
You retain ownership of any content you create or upload within the App. By using the App, you grant us a limited licence to store and process your content solely for the purpose of providing the service to you. We do not claim ownership of your content and will not use it for any other purpose.

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, accuracy, or fitness for a particular purpose. Yayby is a tracking tool and does not provide medical, health, or developmental advice.
To the maximum extent permitted by law, Andrew Hingston shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim related to the App shall not exceed the amount you have paid us in the 12 months preceding the claim.
We may suspend or terminate your access to the App at any time if you breach these Terms or for any other reason at our discretion. You may delete your account at any time through the App or by contacting us.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
